What it Takes to Qualify for a Bankruptcy
The important question is not so much whether one qualifies for a bankruptcy, as much as whether a bankruptcy is the right choice for you. In October 2005, Congress passed a "New" bankruptcy law which was intended to make it harder for individuals to file. However, in our experience, 95% of our clients who qualified before the law, still qualified after the law was passed. Qualifications for Chapter 7 or 13 Bankruptcy
There are distinct differences between the two forms of individual bankruptcy. Chapter 7 is filed by an individual who has overwhelming amount of debt and no way to pay it. They usually have an unstable income and do not have many assets, if any. On the other hand, a Chapter 13 bankruptcy is for people with a stable income and some assets and can go onto a repayment plan for 3 to 5 years to negotiate and pay off specific debts. Normally, they are allowed to keep their assets and enter a court approved repayment plan.
